Terms of Service
Last updated: 1 July 2025
These Terms of Service (“Terms”) govern the provision of technical installation and fit-out services by Alltech Installs Pty Ltd (ABN 80 703 619 64 9) (“we”, “us”, “our”) to you (“you”, “the Client”). By accepting a quotation, engaging our services, or otherwise instructing us to proceed, you agree to be bound by these Terms.
1. About These Terms
These Terms apply to all quotations, purchase orders, engagement letters, and service agreements issued by us, unless we agree otherwise in writing. Where a signed service agreement exists between us, that agreement prevails over these Terms to the extent of any inconsistency.
2. Our Services
We provide technical installation and fit-out services, including but not limited to equipment installation, cabling and infrastructure works, mounting and assembly, technology fit-outs, testing, commissioning, and related advisory services. The specific scope of work for your engagement will be set out in your quotation or scope document.
3. Quotations and Engagement
- Quotations are valid for thirty (30) days from the date of issue unless otherwise stated.
- Quotations are based on the information and site conditions made available to us at the time of preparation.
- A binding contract is formed when you accept our quotation in writing (including by email) or issue a purchase order that we accept.
- Quoted prices are inclusive of GST unless otherwise stated.
4. Fees and Payment
- Invoices are issued in accordance with the payment schedule set out in your quotation, or on completion of the work if no schedule applies.
- Unless otherwise agreed in writing, payment is due within fourteen (14) days of the invoice date.
- We may suspend work, and withhold deliverables, if payment is overdue.
- We may charge interest on overdue amounts at a rate of 2% per month, or the maximum permitted by law, whichever is lower.
- Deposits paid are non-refundable once work has commenced, except where required by law.
5. Variations
If you request changes to the agreed scope, or if unforeseen site conditions, concealed services, or defects require additional work, we will provide a written variation quoting the additional cost and time impact. Work covered by a variation will only proceed after your written approval. Additional costs arising from delays or instructions from third parties engaged by you may also be treated as a variation.
6. Client Obligations
You agree to:
- Provide safe, reasonable, and timely access to the site and work areas during agreed hours;
- Ensure the site is safe and complies with applicable work health and safety requirements;
- Obtain all necessary approvals, permits, strata or landlord consents, and authority notifications required for the work;
- Disclose the location of concealed services, hazards, asbestos, or other known site risks;
- Provide adequate power, lighting, and access to essential services where required.
We reserve the right to reasonably pause work, and to charge for resulting standby time, where these obligations are not met.
7. Australian Consumer Law
Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy conferred by the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)) or any other applicable law that cannot be excluded, restricted, or modified.
Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. For major failures with the service, you are entitled to cancel your service contract with us and to a refund for the proportion of the contract price unused, or to compensation for its reduced value. You are also entitled to a reasonably foreseeably compensatory remedy for any other reasonably foreseeable loss or damage. If the failure is not a major failure, you are entitled to have the failure rectified in a reasonable time and, where applicable, to compensation for any reduction in the value of the goods or services.
8. Workmanship Warranty
In addition to your rights under the Australian Consumer Law, we warrant our workmanship against defects arising from faulty installation for a period of twelve (12) months from completion. This warranty does not cover defects caused by misuse, unauthorised modification, third-party works, normal wear and tear, or client-supplied materials or equipment. To make a warranty claim, contact us at ceo@alltechinstalls.online with details of the issue.
9. Liability
To the extent permitted by law, and except for guarantees under the Australian Consumer Law:
- We are not liable for indirect, special, or consequential loss, loss of profit, or loss of data arising from the services;
- Our total liability for any claim arising from the services is limited, at our option, to resupply of the services or the cost of resupply, or payment of the cost of having the services resupplied;
- Our liability is limited where the loss arises from your breach of these Terms, your instructions, or site conditions not disclosed to us.
10. Delays and Cancellation
We will use reasonable endeavours to meet agreed timeframes; however, we are not liable for delays caused by events beyond our reasonable control, including supplier delays, site access issues, extreme weather, or changes to government or authority requirements. You may cancel an engagement by giving written notice. If you cancel after we have commenced work or incurred costs (including labour, materials, or administration), you will be liable for reasonable costs incurred up to the date of cancellation.
11. Intellectual Property
All quotations, drawings, designs, schedules, documentation, and other materials prepared by us remain our property. You are granted a licence to use these materials for the purposes of the engagement and the ongoing operation and maintenance of the installed works. You may not reproduce or disclose our documentation to third parties for the purpose of having the work performed by another contractor without our written consent.
12. Privacy
We handle personal information in accordance with our Privacy Policy. By engaging our services, you consent to the collection, use, and disclosure of personal information as described in that policy.
13. Dispute Resolution
If a dispute arises, please contact us first at ceo@alltechinstalls.online. Both parties agree to attempt to resolve any dispute in good faith through direct discussion before commencing formal proceedings, except where urgent injunctive relief is required.
14. Governing Law
These Terms are governed by the laws of Victoria, Australia, and both parties submit to the non-exclusive jurisdiction of the courts of Victoria and the courts competent to hear appeals from those courts.
15. Changes to These Terms
We may update these Terms from time to time. The current version will always be published on this page. The Terms applicable to your engagement are those in force at the time you accept our quotation, unless varied in writing.
